Digest Summary:  The California Constitution gives workmen the right to a mechanics' lien for the value of labor and materials provided for the improvement of real property.
This bill would enact the Home Improvement Consumer Protection Act of 2002 which would provide that if a home improvement contract, as defined, is executed in an amount not exceeding $25,000, regardless of later increases in the contract price, the homeowner may setoff the amount of good-faith payments to the original contractor against the aggregate amount of enforceable mechanics' liens and stop notice claims, in an amount not exceeding $25,000.

This bill would require, instead, with respect to bids on public contracts for construction work in counties having a population of more than 500,000 persons, unless waived by the county with respect to a public work the total cost for which does not exceed $100,000, the person to whom the contract is awarded provide (1) a payment bond, as defined, if the person is an original contractor, as defined, and (2) a bond that is executed by an admitted surety insurer that meets all surety industry performance standards and financial strength ratings as may be set by the county and is approved by the board of supervisors for the faithful performance of the contract.

Digest Summary:  Existing law known as the Living Wage Act of 1996, an initiative that was added by Proposition 210 approved by the voters at the November 5, 1996, statewide general election, required establishment of a minimum wage for all industries of not less than $5.75 per hour on and after March 1, 1998.
This bill, which would be known as the Minimum Wage Protection Act, would require the minimum wage to be adjusted on January 1, 2003, and annually thereafter , to maintain employee purchasing power.
