New Annual Fee for Public Works Contractors Effective July 1, 2014

​In recent newsletters we reported that the Governor's 2014-15 Budget included a proposal to consolidate all public works and prevailing wage enforcement under a single unit, with that unit supported by a new registration fee on contractors working on public projects.

That fee becomes a reality on July 1, 2014. All contractors and subcontractors that intend to bid or work on public projects will be required to pay a non-refundable annual fee set initially at $300. The fee may be adjusted (but not more than annually) so that it generates adequate funds to cover program costs which are currently $11.4M.

AB 1705 - Moving Through Legislative Process

Assembly Bill 1705 passed the Senate policy committee with many trades testifying alongside us. Now, to the Senate Floor, where all Senators vote. 

The bill closes a loophole in a recent law that allows public entities to declare any construction project as "substantially complex." If the agency does that it can then avoid (evade) the 5% cap on retention that we helped secure last year in SB 293. And that's exactly what some school districts did.

AB 1705 requires the agencies to explain what makes a project "SC" and to also notify bidders that in so doing, the 5% cap is removed and more money may be retained. ASAC is very pleased to have CalSMACNA and NECA as co-sponsors to the bill which is supported by several other subcontractor organizations.

The Subletting and Subcontracting Fair Practices Act Goes Into Effect on July 1, 2014

Last year Governor Brown signed into law AB 44, a new twist to The Subletting and Subcontracting Fair Practices Act (Act). The change goes into effect on July 1, 2014. 

If you are a contractor submitting a bid to a public entity for a California public works project, you will be required to include the contractor license number of each subcontractor you have listed.

The Act requires any public entity taking bids for the construction of any public work or improvement to specify that any person making a bid or offer to perform the work shall, in his or her bid or offer, include specified information, including the name and location of the place of business of each subcontractor who will perform work or labor or render service to the prime contractor in or about the work or improvement. The July 1, 2014 change added the requirement that the subcontractor's license now be included.

ASA-PAC Prior Approvals – A Necessary Part of the Program
