The second annual California Subcontractors Legislative Conference on April 2, 2014 was considered a great opportunity for subcontractors to Capitalize on Success in Sacramento. The gathering was organized with the goal of giving subcontractors and suppliers a voice, to have them speak to their legislative representatives and inform them of their view on a few very important legislative bills currently being considered by the legislature.

Dan McLennon, Esq., ASAC Government Relations Chairman, McLennon Law Corporation, who also served as the day’s master of ceremonies, Scott Holbrook, Esq., ASAC Legal Counsel, Crawford & Bangs LLP, and Skip Daum, ASAC Legislative Advocate presented a Prelude to Next Year. Plans for 2015 include three legislative movements that include • Subcontractor Right to Stop Work for Non-Payment • 474 Clean Up • Remove "unless otherwise agreed to in writing" An opportunity for the audience to ask questions and identify current and emerging issues for subcontractors and suppliers was given with the question asked “What’s On Your Mind?” At this time the problems with OCIPs and CCIPs was mentioned by Union Roofing Contractors Association Executive Director Ron Johnston | Keynote speaker for the event was Robert Padilla, Small Business Advocate, California High-Speed Rail Authority. He began his talk with a comment that no matter how you feel about this huge project, it will bring jobs to California. He then explained about the phases of the project, how to qualify for the jobs, and how his department intends to make sure small businesses get a share of the work. Assembly Member Bob Wieckowski, was presented an appreciation award for Authoring SB 164 (2013) (PPP Bonds). This bill was sponsored by ASAC last year, and signed by Governor Brown, taking effect January 1 of 2014. The plaque was presented by Brett Eckles, ASAC President.
Attendees had the opportunity to visit their own senator and assembly member after learning how to lobby their position on two bills affecting the construction industry. Talking points were provided.
• AB 1705 SUPPORT; Sponsored by ASA California This bill closes a loophole that was inadvertently created in last year’s SB 293 (Padilla) which capped retention proceeds at 5% in public works projects. The language in that bill also allows public agencies to “declare” a project to be “substantially complex”, thereby allowing the agency to exceed the bill’s 5% cap on retained payments (retentions). In essence, public entities can circumvent the Legislature’s intent in SB 293 without legitimate basis and without accountability.
• AB 2471 SUPPORT; Closes the “change order” loophole in prompt payment laws for public construction projects that lets a public agency owner avoid having to make prompt payment for extra work. Just as all of us must pay our bills on time, the government should as well.
More than 2,000 bills had been introduced prior to the conference, and dozens of them deal with payments, liability, remedies, bonds, contract rights and obligations, etc.
Planning and marketing the event was a joint effort among the hosting organizations/companies. They determined the day’s program, their logo appeared on the conference materials, and their identity and issues were presented to legislators and key capitol staff.
